Terms of Service

1. About Koutura

Koutura (“we”, “us”, “our”) is a virtual try-on service that lets parents and legal guardians preview clothing on their children using AI-generated imagery. The service is operated from the Netherlands and is available at www.koutura.app.

2. Eligibility

You must be at least 18 years old and a parent or legal guardian of any child whose image you upload to use this service. By creating an account, you confirm that you meet these requirements and that you have lawful authority to provide consent for the processing of your child’s image data.

3. Account & Access

You are responsible for keeping your login credentials secure. One account per person. We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behaviour.

4. Credits & Payments

• New accounts receive a one-time allotment of free starter credits.
• Subscription plans provide a monthly credit allocation. Unused subscription credits reset at the start of each billing cycle.
• Top-up credits are one-time purchases and do not expire as long as your account remains active.
• All prices are in euros and include applicable VAT.
• Payments are processed by Stripe. By purchasing credits or a subscription, you agree to Stripe’s terms of service.
• Refunds are handled on a case-by-case basis. If a generation fails due to a system error, the credit is automatically refunded.

5. Subscriptions & Cancellation

Subscriptions renew automatically each month. You can cancel at any time via the Subscription management page or Stripe Customer Portal. Upon cancellation, your plan remains active until the end of the current billing period. Unused subscription credits are forfeited at that point. Top-up credits you have purchased remain available.

6. Acceptable Use

You agree not to:

• Upload images of children you are not the parent or legal guardian of.
• Use the service for any unlawful, harmful, or exploitative purpose.
• Attempt to reverse-engineer, scrape, or extract our AI models or systems.
• Circumvent credit limits, usage restrictions, or security measures.
• Resell or redistribute generated images for commercial purposes without permission.

We reserve the right to remove content and terminate accounts that violate these rules without prior notice.

7. AI-Generated Content

• Generated images are AI previews and may not accurately represent actual clothing fit, colour, or appearance.
• We do not guarantee the accuracy, completeness, or suitability of any AI output.
• You retain rights to images you upload. Generated outputs are provided for your personal, non-commercial use.
• Uploaded clothing images are temporary and automatically deleted after the generation is complete.

8. Data & Privacy

Your use of Koutura is also governed by our Privacy Policy, which describes how we collect, use, and protect your data — including your child’s image data. Please read it carefully.

9. Availability & Liability

• The service is provided “as is” without warranties of any kind.
• We do not guarantee uninterrupted or error-free access. Scheduled or unscheduled maintenance may occur.
• To the maximum extent permitted by Dutch and EU law, our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, or consequential damages arising from use of the service.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer protection rights under EU law.
